Terms of Service #

These Terms of Service ("Terms") govern your access to and use of WatchThatSite ("WatchThatSite", "we", "us", or "our"), including our website, applications, APIs, and related services (together, the "Service"). WatchThatSite is operated by Samya Brata Maji, an individual sole proprietor based in India.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility #

You must be at least 16 years old (or the age of majority in your jurisdiction, whichever is higher) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. The Service #

WatchThatSite lets you monitor web pages for changes and receive notifications through channels you connect (such as email, Slack, Discord, and Telegram). The Service may include optional AI-assisted diffing on a bring-your-own-key ("BYOK") basis.

We may add, change, suspend, or discontinue features at any time. We aim to keep the Service reliable but do not guarantee uninterrupted availability, that every change on a monitored page will be detected, or that notifications will always be delivered on time.

3. Accounts #

  • You are responsible for providing accurate registration information and keeping it current.
  • You are responsible for safeguarding your account credentials and for all activity under your account.
  • Notify us promptly at support@watchthat.site of any unauthorized use or security breach.
  • You may sign in with email/password or with a supported third-party provider (such as Google); your use of that provider is subject to its own terms.

4. Acceptable Use #

You agree not to use the Service to:

  • Monitor any website or resource that you are not authorized to access, or in violation of that site's terms of service, robots.txt, or applicable law.
  • Circumvent access controls, authentication, paywalls, or rate limits of any third-party site.
  • Place an unreasonable load on any third-party website, or use the Service to conduct denial-of-service, scraping abuse, or similar activity.
  • Monitor or collect data in violation of any person's privacy or data-protection rights.
  • Upload, store, or transmit unlawful, infringing, malicious, or harmful content.
  • Reverse engineer, resell, or provide the Service to third parties except as expressly permitted.
  • Interfere with, disrupt, or compromise the integrity or security of the Service.

You are solely responsible for the URLs and resources you choose to monitor and for ensuring you have the right to do so. We may suspend or terminate accounts that violate this section.

5. Your Content and Data #

  • Your configuration and monitored content. You retain any rights you have in the monitors, notification settings, and page snapshots processed through your account. You grant us a limited license to host, process, and display this content solely to operate the Service for you.
  • BYOK keys. If you enable AI-assisted diffing, you provide your own AI provider API key. You are responsible for your use of, and compliance with, that provider's terms and any associated costs. We store your key encrypted and use it only to perform diffing you request.
  • Responsibility. You represent that your use of the Service and the content you process do not infringe any third-party rights or violate any law.

6. Plans, Billing, and Refunds #

  • Free tier. The Service is currently offered free of charge. We may modify, limit, or discontinue the free tier at any time.
  • Future paid plans. If we introduce paid plans, payments and subscriptions will be processed by Polar.sh, which acts as our merchant of record, and your purchase will also be subject to Polar's terms and policies. Paid plans would be billed in advance on a recurring basis and renew automatically until cancelled.
  • No refunds. Payments, if any, are non-refundable except where a refund is required by applicable law.
  • Taxes. Prices may be exclusive of applicable taxes, which Polar may collect as merchant of record.

7. Intellectual Property #

The Service, including its software, design, and content (excluding your content and third-party content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

8. Third-Party Services #

The Service integrates with third-party services (such as Google, Slack, Discord, Telegram, Resend, Polar.sh, your AI provider, and the websites you monitor). We are not responsible for third-party services, their availability, or their content, and your use of them is governed by their own terms.

9. Disclaimers #

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT IT WILL DETECT EVERY CHANGE OR DELIVER EVERY NOTIFICATION. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of Liability #

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY MISSED OR DELAYED CHANGE DETECTION OR NOTIFICATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) USD 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification #

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, the resources you monitor, or your violation of these Terms or any law or third-party rights.

12. Termination #

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends and we may delete your data in accordance with our Privacy Policy. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive termination.

13. Governing Law and Disputes #

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to applicable law, the courts located in Mumbai, India will have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service. Nothing in this section limits any mandatory consumer rights available to you in your country of residence.

14. Changes to These Terms #

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide more prominent notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
